TERMS AND CONDITIONS FOR PARTICIPATION IN THE GAME
“PALLTEX’S BIRTHDAY – GIVEAWAY”
1. GENERAL PROVISIONS. ORGANIZER
1.1. These Terms and Conditions /“T&C”/ regulate the rules for conducting the game “PALLTEX’S BIRTHDAY – GIVEAWAY”, hereinafter referred to as the “Game”.
1.2. Organizer of the game “PALLTEX’S BIRTHDAY – GIVEAWAY” is “PALLADIUM” EOOD, UIC: 831615024, a commercial company registered under the laws of the Republic of Bulgaria, with registered office and management address: Sofia, Kazichene, 1A Vasil Levski St., hereinafter referred to as the “Organizer”.
1.3. By participating in the Game, each participant accepts these Terms and Conditions in full and agrees that their relationship is solely with the Organizer.
1.4. These Terms and Conditions have been prepared in accordance with applicable Bulgarian legislation and are published for the entire period of the Game on the Organizer’s official website www.palltex.bg
1.5. The Game is organized and conducted throughout the territory of the Republic of Bulgaria.
2. PERIOD OF CONDUCT
2.1. The Game is conducted during the period from 09 June to 16 June 2026, inclusive, hereinafter referred to as the “Period of Conduct”.
2.2. The Organizer has the right to unilaterally extend, shorten, terminate or change the Period of Conduct without owing any compensation to the participants, by publishing an announcement on the Organizer’s official Instagram profile.
3. RIGHT TO PARTICIPATE
3.1. Any natural person who has reached the age of 18 and meets the participation conditions set out in these Terms and Conditions has the right to participate, hereinafter referred to as the “Participant”.
3.2. Participants must have an identity card to verify their identity when accepting the prize.
3.3. Only adults with a correspondence address in the Republic of Bulgaria may participate in the Game.
3.4. The following persons are not eligible to participate:
1) Employees, managers, partners or representatives of the Organizer;
2) Persons directly involved in conducting the Game (marketing, advertising agencies, subcontractors);
3) Spouses, relatives in the direct line and relatives in the collateral line up to the second degree, inclusive, of the persons under item 3.4 (1) and item 3.4 (2).
3.5. The Organizer has the right at any time to request an identity document to verify the age and identity of any participant and/or winner.
3.6. A Participant who does not meet the conditions set out in these Terms and Conditions shall be disqualified without the right to compensation.
4. METHOD OF PARTICIPATION
4.1. The Game is conducted in accordance with these T&C, and each Participant is obliged to comply with the conditions and requirements regulated therein.
4.2. To participate in the Game, the participant must cumulatively fulfill the following conditions on Instagram within the Period of Conduct:
1) Follow the Organizer’s official profile palltex;
2) Like the post announcing the Game and share it in a story;
3) Leave a comment with a birthday wish for the company under the post. The profile must belong to a real person with an active personal profile.
4.3. One person /one participant/ may participate more than once in the Game by posting more than one comment. Spam comments, comments from invalid profiles, advertising profiles or fake accounts may be removed at the Organizer’s discretion.
4.3. Participation in the Game does not require the purchase of goods or services.
4.4. By performing the actions under item 4.2 of these T&C, the participant confirms that they are familiar with and fully accept these Terms and Conditions, including the clauses on liability, personal data and publicity.
5. DESCRIPTION OF THE PRIZE
5.1. The prize, hereinafter referred to as the “Prize”, consists of 3 pieces of clothing and shoes available on the Organizer’s website, with each prize potentially including a complete look for different work environments – medical, workwear and chefwear.
The Prizes are intended for 3 winners.
5.2. The Prize is personal, specific, indivisible and is not subject to:
1) Exchange for money or any other monetary or non-monetary equivalent;
2) Transfer to a third party, unless the Organizer gives explicit written consent;
3) Change of destination at the Winner’s request.
5.3. The Organizer reserves the right to provide the prize to each of the participants within up to 5 calendar days after the drawing and announcement. If by the end of this period the winners do not claim their prizes, the prizes remain with the Organizer.
Without owing compensation for these changes.
6. DETERMINATION OF THE WINNERS
6.1. The winners will be drawn at random after the expiry of the Period of Conduct, using random selection software, e.g. random.org or another similar tool, under the supervision of a representative of the Organizer.
6.2. The Organizer has the right to check whether the profile of the drawn participant is real and whether the participant has complied with all participation conditions. Profiles that are obviously fake, created solely for games, without normal activity or using a false identity, may be disqualified.
6.3. In the event that the drawn participants do not meet the conditions or cannot be confirmed, the Organizer has the right to draw new winners in the same manner.
7. NOTIFICATION AND ACCEPTANCE OF THE PRIZE
7.1. The name/username of the Winners will be announced via Story/post on the official Instagram profile palltex and/or via direct message (Direct Message) to the selected account.
7.2. The Winners must respond and contact the Organizer within 5 (five) calendar days from the sending of the notification or its publication on the official Instagram profile palltex.
7.3. If the Winners do not respond within this period, refuse the Prize, or do not provide the necessary data (name, telephone number and address for receiving the prize), the Prize shall be deemed refused. In this case, the Organizer has the right to draw new winners.
7.4. After confirmation of the Winners, the Organizer and the Winners will agree on possible dates for sending the Prizes. If no agreement is reached within a reasonable period (up to 10 working days after confirmation), the Organizer may consider the Prizes refused and provide them to other participants, without owing any compensation.
7.5. The Organizer is not obliged to conduct correspondence related to non-winning Participants, including notifying them that they have not won.
8. REQUIREMENTS FOR RECEIVING THE PRIZES
8.1. In order to receive the Prizes, the Winners are obliged to sign that they:
1) Agree with the Terms and Conditions of the Game;
2) Waive any future claims against the Organizer in connection with the Game.
8.2. Refusal by any of the Winners to provide the necessary data shall be considered a refusal of the Prize. In this case, the Organizer does not owe any compensation.
9. LIABILITY AND LIMITATION OF LIABILITY
9.1. The Organizer is not liable for:
1) Personal, property/material or non-material damages, lost profits, moral damages, additional expenses or other adverse consequences arising directly or indirectly from the acceptance and/or use of the Prize.
9.2. The Organizer is not liable in cases of “force majeure circumstances”, including but not limited to: natural disasters, strikes, war, epidemics, states of emergency, changes in legislation, terrorist acts, technical failures, airport closures, changes in local rules and other similar circumstances.
9.3. The Winners accept the Prize entirely at their own risk and on their own behalf, and undertake not to bring claims, lawsuits or requests for compensation against the Organizer, regardless of their legal basis, related to: participation in the Game; the drawing; receiving, using or being unable to use the Prize.
9.4. The maximum total liability of the Organizer to all participants, regardless of the grounds, is limited to the actual value of the Prize under item 5.4. Under no circumstances does the Organizer owe compensation for lost profits.
9.5. Objections regarding the conduct of the lottery shall be submitted in writing to the organizer within 7 days after the announcement of the result.
10. TAXES AND PUBLIC REPORTING
10.1. The Organizer is not responsible for any fees, taxes or fines that may arise in connection with winning the Prize, and participants are warned that the Prize may constitute taxable income under applicable Bulgarian legislation.
10.2. The Organizer will act in accordance with legal requirements regarding tax treatment and, where applicable, will pay/withhold/declare the tax due.
10.3. The Winners undertake to cooperate by providing data necessary for the possible declaration of the prizes in accordance with the law.
11. PERSONAL DATA (GDPR)
11.1. The Organizer is a personal data controller within the meaning of the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, and the data provided by the Participants will be used in accordance with these T&C and applicable legislation.
11.2. By participating in the Game, participants voluntarily provide the following personal data: Instagram username and publicly visible profile.
11.3. The Winner may additionally be asked to provide: full name, date of birth, personal identification number and/or identity card/passport number, email, telephone number, address for receiving the prize, etc., solely for the purposes of:
1) Verifying identity and age;
2) Accounting and tax requirements;
3) Publishing information about the Winners (see item 12).
11.4. The legal basis for processing the provided data is the performance of these Terms and Conditions and the legitimate interest of the Organizer to conduct the Game transparently.
11.5. The data will be stored for no longer than necessary for conducting the Game, providing the Prizes and fulfilling legal requirements, including accounting requirements.
11.6. Participants have the right to access their personal data, the right to correction, the right to restriction of processing and the right to lodge a complaint with the Commission for Personal Data Protection. Deletion of data before the end of the Game or before the Prize is provided leads to automatic disqualification, as it makes it impossible to provide the Prize.
12. PUBLICITY AND MARKETING
12.1. By participating in the Game, participants give their consent for the Organizer to use their usernames/accounts, first name and/or photo material voluntarily published by them in connection with the Game, for the purposes of announcing the Winners, marketing, PR and promoting future games/campaigns of the Organizer, without owing additional remuneration.
12.2. The Winners give their consent to be publicly announced on the Organizer’s profile and agree that their names/accounts may be publicly published as “Winners”.
12.3. The Organizer may request that the Winners provide photos/stories with the prize, and this content may be reposted on the Organizer’s profiles for marketing purposes. If the Winners provide such content voluntarily, they grant the Organizer a non-exclusive, free right to use, reproduce, adapt, publicly share and distribute this content for an unlimited period and without territorial limitation.
13. DISQUALIFICATION
13.1. The Organizer has the right to disqualify without warning any Participant whom it suspects or finds to have engaged in manipulative actions aimed at winning the prize.
13.2. The Organizer has the right to disqualify a participant without prior notice in the event of:
1) Suspicion of malicious manipulation of the Game mechanism;
2) Use of fake profiles, mass tags /bot behavior/ or purchased followers solely for the Game;
3) Attempted fraud, threats, pressure, insult, discriminatory statements, defamatory content or any action that damages the reputation of the Organizer;
4) Failure to comply with the requirement under item 3 (age);
5) Refusal to sign the declaration under item 8.
13.3. Disqualified participants are not entitled to compensation.
14. TERMINATION, AMENDMENT AND INVALIDITY
14.1. The Organizer unilaterally determines the rules and conditions under which the Game is conducted and may at any time amend these Terms and Conditions, suspend them, change and supplement them at its discretion, or terminate the Game entirely or partially if events occur that prevent its normal conduct, including force majeure, without owing any compensation to the participants.
14.2. In the event of termination of the Game before the drawing, the Organizer does not owe provision of the Prizes.
14.3. If any clause of these Terms and Conditions is declared null and void or unenforceable, this does not affect the validity of the remaining clauses. In its place, the provision closest in economic meaning and legal effect and permitted by law shall apply.
15. APPLICABLE LAW AND DISPUTES
15.1. For all matters not regulated herein, the applicable legislation of the Republic of Bulgaria shall apply.
15.2. All disputes arising in connection with the conduct of the Game, the interpretation or application of these Terms and Conditions, as well as in connection with the provision/non-provision of the Prizes, shall be resolved by the competent Bulgarian court at the registered office of the Organizer.
15.3. By participating in the Game, participants expressly waive the right to bring claims outside the limits set out in these Terms and Conditions.
16. PUBLICATION OF THE TERMS AND CONDITIONS
16.1. These Terms and Conditions are publicly available for the entire Period of Conduct of the Game at: https://palltex.bg/bg/giveaway.
16.2. By starting participation in the Game, each participant fully and unconditionally accepts these Terms and Conditions.
