Terms and Conditions for Using the Online Store www.palltex.bg
Please read these terms carefully. If you use this site, it is considered that you agree with them. If you do not agree with these terms, please do not use the site.
BASIC CONCEPTS AND TERMS
"SELLER" refers to "Palladium" Ltd. through the online store www.palltex.bg. The Seller is the entity with which the User enters into a remote sales contract for a specific product (item) in the online store.
"USER" (CLIENT) refers to a legally capable individual who has agreed to these Terms and Conditions in relation to ordering and purchasing goods offered through the online store.
"ONLINE STORE" refers to the website www.palltex.bg, which serves as a virtual platform for offering goods for sale and for reaching an agreement between the SELLER and the USER for the purchase and sale of a specific product.
"Palltex" (Palltex) is the trade name of the company "Palladium" Ltd., UIC: 831615024, with its headquarters and registered address in Kazichene 1532, Vasil Levski Street No. 1A, which creates and maintains the online store, sells goods in the store, and determines these Terms and Conditions under which goods are sold on the site www.palltex.bg. "Palladium" Ltd. has the full right to unilaterally change the content of the website, as well as the ways of accessing it.
"ORDER" is an action that signifies the User's request to purchase one or more specific goods (products) through the online store www.palltex.bg. The order is fulfilled within 2 to 5 days (except during periods of significant discounts when the workload increases), and the CLIENT/USER who made the purchase request receives notifications at the email address used for registration regarding the status of the order.
"SALES CONTRACT" refers to the remotely concluded sales contract for goods between the Seller and the User through this online store.
"COURIER" refers to a business entity that physically delivers the purchased goods to an address specified by the User and operates under the requirements of the Postal Services Act.
"BROCHURE / NOTICE / NEWSLETTER" refers to electronic informational messages related to goods sold in the online store over a certain period, which may be posted on the website or sent by email to the User.
2. TERMS OF USE FOR THE ONLINE STORE PALLTEX.BG
2.1. Browsing the online store www.palltex.bg is entirely free and accessible from all parts of the world.
2.2. All texts, images, and multimedia content on the website www.palltex.bg are the property of "Palladium" Ltd.! It is prohibited to copy, transmit, distribute, or store part or all of the content in any form without prior written consent from "Palladium" Ltd.! For inquiries - estore@palltex.bg.
2.2.1. There may be discrepancies in the color range of the products shown in the photos compared to the actual products, depending on the screen of the device the User is viewing them on, for which the Merchant is not responsible. In very rare cases, products from the OUTLET category may have slight differences between the photo in the online store and the actual product due to different batches.
2.3. No modifications, reproduction, distribution, direct transmission, display, presentation, reproduction, publication, authorization, or sale of information owned by "Palladium" Ltd. are allowed.
2.4. To make purchases from the online store www.palltex.bg, the following information is required: email (mandatory when creating an account), recipient's name (mandatory), phone number, and delivery address (mandatory unless an order is placed through the "Quick Order" button). In the case of a "Quick Order," a representative will contact the customer to clarify the details (note that "Quick Order" does not mean "Quick Delivery"). Orders placed with registration are processed with priority.
2.5. All prices listed on the site are in Bulgarian levs (BGN) and include VAT.
3. ORDERING GOODS AND PRODUCTS
3.1. To place an order in the online store, the User must provide:
3.1.1. A valid email address.
3.1.2. A correctly filled-out delivery and billing address (mandatory).
3.1.3. Correct contact details – full name, phone number (mandatory).
3.2. The order is registered, i.e., placed with the online store after clicking the "Complete" button, which appears on the final page.
3.3. Upon placing an order, the User receives an order confirmation at the provided email address, which includes the order number, date, and time of the order.
3.4. If the ordered item (specific model) is not in stock, a our administrator will notify the User. If the User does not agree to substitute the item with another (similar model), the order may be modified or canceled.
3.5. Orders in the www.palltex.bg online store are accepted 24 hours a day, 7 days a week by the site’s system.
3.5.1. The working hours of the www.palltex.bg online store administrators are Monday to Friday, from 9:00 AM to 5:30 PM. Online consultations regarding products can be conducted during the store's working hours.
3.5.2. All orders placed before 10:00 AM are processed and shipped on the same day.
3.5.3. All orders placed after 10:00 AM are usually processed on the next working day.
3.6. Orders received without correct buyer (User) details or missing such details will be marked as "Pending" until all required User information is provided.
3.7. The User may cancel an order without providing a reason for the cancellation.
3.8. Cancellations can be made by phone or by email to the address specified on the site: estore@palltex.com. To be valid, the cancellation must include the User's full name as registered on the site, a contact phone number, and the order number.
4. DELIVERY OF ORDERED GOODS
4.1. Once an order is placed on the www.palltex.bg website, the automated system of the online store notifies the User by email of the successfully received order.
4.2. The order is sent for processing to the warehouse, and the client receives a notification of its status at the provided email address.
4.3. Delivery of ordered goods is not carried out on weekends and public holidays.
4.3.1. Delivery is made within 2 to 5 days from the time of order registration. This period may be extended during busy campaign periods, national holidays, or due to adverse weather conditions.
4.4. The www.palltex.bg online store uses the courier company Econt Express for deliveries, with usual delivery hours from 9:00 AM to 5:30 PM.
4.5. Delivery is made to the address provided by the User or to the office of the respective courier company.
4.6. For orders over 120 BGN, delivery is always free! For orders under 120 BGN, the delivery fee is 7 BGN, which is automatically added during the order process. The courier service for returning an order after review is at the customer's expense!
4.7. If the User does not provide access and conditions for the delivery of the goods at the specified address within the specified time, the Seller is released from the obligation to fulfill the declared delivery.
5. PAYMENT
5.1. Payment for the ordered goods can be made using one of the following methods:
5.1.1. Cash or via POS terminal upon receiving the shipment (cash on delivery);
5.1.2. Payment by debit/credit card;
5.1.3. Bank transfer.
6. CONTRACT CANCELLATION. CLAIMS FOR GOODS/ORDERS
6.1. The User has the right to make a claim or return goods purchased from the online store within 30 days from the date the order was placed.
6.2. The contract can be canceled in front of the courier during delivery if the goods are delivered after the agreed period for reasons beyond the User's control and not due to force majeure.
6.3. Upon cancellation of the contract, the User is obliged to return the purchased goods in their original condition with the label intact.
6.4. In case of contract cancellation, if the User has paid for the goods, the amount for the purchased products, excluding the delivery fee (if paid), will be refunded within 30 (thirty) days from the exercise of the right to cancel the contract via email or online through the User’s account in the online store. No refunds will be made until the goods are returned. If the goods are not returned within the stated period, the cancellation of the contract will not take effect.
6.5. A claim can be made if the purchased goods do not match the agreed terms between the parties in the sales contract. Non-conformity may include:
- Identified shortages;
- Product defects;
- Mismatch with the advertised size;
- Mismatch with the advertised brand.
6.6. Claims can be submitted to "Palladium" Ltd. at the specified email estore@palltex.com, by the User sending photos of the received goods and the receipt that accompanied the order.
6.7. In case of a claim, the User can choose to exchange the specific item for the same one without defects or in a different size or color, or return the goods for a refund of the paid amount. A www.palltex.bg online store administrator may propose the exchange of the item or suggest other options.
6.8. Returns in case of a claim, except in cases of factory defects or damage during transportation, are subject to the following conditions:
- The item retains its good commercial appearance (the item is not torn, scratched, worn, washed, or ironed).
- There are no damages caused by improper use.
- The original packaging and label are intact.
6.9. Return of goods, whether for contract cancellation or size exchange, should be made by the User logging into their account in the online store and downloading the exchange or return form.
6.10. For product exchanges, the shipping costs in both directions are borne by the User unless the reason for the exchange or return is due to www.palltex.bg's fault.
6.11. In case of a dispute that cannot be resolved jointly, you may use the ODR platform. All products on the website are subject to updates. Information on the website may be changed at any time without prior announcement on the site.
7. INFORMATION ABOUT CONSUMER RIGHTS ARISING FROM THE LEGAL WARRANTY UNDER ARTICLES 112-114 OF THE CONSUMER PROTECTION ACT
Article 112.
If the consumer goods do not conform to the sales contract, the consumer has the right to file a complaint and request that the seller brings the goods in line with the sales contract. In this case, the consumer may choose between having the goods repaired or replaced with new ones unless this is impossible or the chosen method of compensation is disproportionate compared to the other.
A method of compensation is considered disproportionate if it imposes costs on the seller that are unreasonable compared to the other method of compensation, taking into account:
- The value of the consumer goods if there were no lack of conformity;
- The significance of the lack of conformity;
- The possibility of offering the consumer another method of compensation that does not cause significant inconvenience.
Article 113.
When the consumer goods do not conform to the sales contract, the seller is obliged to bring them into conformity with the sales contract.
Bringing the consumer goods into conformity with the sales contract must be done within one month from the date the complaint is filed by the consumer.
After the expiration of the period mentioned above, the consumer has the right to cancel the contract and be refunded the paid amount or to request a reduction in the price of the consumer goods according to Article 114.
Bringing the consumer goods into conformity with the sales contract is free of charge for the consumer. The consumer is not liable for shipping costs or for materials and labor associated with the repair, nor should they bear significant inconvenience.
The consumer may also claim compensation for damages suffered due to the lack of conformity.
Article 114.
If the consumer goods do not conform to the sales contract and the consumer is not satisfied with the resolution of the complaint under Article 113, they have the right to choose between one of the following options:
- Cancellation of the contract and refund of the amount paid;
- Price reduction.
The consumer cannot claim a refund or a price reduction if the trader agrees to replace the consumer goods with new ones or to repair the goods within one month from the filing of the complaint.
The trader is obliged to satisfy a request for contract cancellation and refund the amount paid by the consumer if, after three complaints have been satisfied by repairing the same goods, another non-conformity with the sales contract occurs.
The consumer cannot claim contract cancellation if the non-conformity of the consumer goods with the contract is insignificant.
8. LIABILITY
8.1. The Seller of the goods is responsible for defects in the goods, for fulfilling the distance sales contract, as well as for refunding paid amounts.
8.2. "Palladium" Ltd. bears no liability towards third parties if such a party believes that any information published on the online store violates copyright or other intellectual property rights.
9. PERSONAL DATA PROTECTION; BROCHURES AND NOTIFICATIONS
"Palladium" Ltd. is registered as a data controller and is responsible for compliance with the provisions of the General Data Protection Regulation 2016/679. By accepting these general terms and conditions, the user gives their explicit and unconditional consent for an indefinite period, until its potential explicit written revocation, that the personal data provided by them may be collected, stored, processed, and used by "Palladium" Ltd. and its authorized third parties for the purposes of the correct execution of the distance sales contract and the delivery of the ordered goods, for business analyses to improve the services provided by the COMPANY, for marketing and advertising purposes and analyses, for providing information about marketing campaigns, promotions, and sweepstakes organized by "Palladium" Ltd., for sending advertising electronic messages, direct marketing messages, as well as for any other purposes permitted by law. The personal data that "Palladium" Ltd. collects from its customers in connection with processing and delivering their orders are specified in the registration form and in the Cart during the order process.
Providing personal data is entirely voluntary on the part of the customer, and they may obtain information at any time regarding the use and processing of their personal data, as well as request that their profile containing personal data be deleted, by sending a written request to estore@palltex.com.
The information you provide for registration, as well as any information provided during the use of the www.palltex.bg site, is confidential.
9.1. When a User registers in the online store by creating a Profile on the Website, they agree to receive brochures and/or notifications from "Palladium" Ltd. via email.
9.2. The User can opt out of receiving brochures and/or notifications via email at any time:
9.3.1. By using the specially provided unsubscribe link contained in each brochure and/or notification.
9.3.2. By contacting "Palladium" Ltd. at the specified email estore@palltex.com with an explicit request not to receive brochures and/or notifications.
9.4. "Palladium" Ltd. reserves the right to choose to whom to send brochures and/or notifications, as well as to remove from its database any User who has consented to receive brochures and/or notifications.
10. COLLECTION AND USE OF PERSONAL DATA
Personal data is any information that can be used to identify a person. You may be asked for personal information anytime you interact with us or our partners in order to provide our products and services. Only in compliance with this Data Protection Policy and all applicable legal provisions, the Data Controller and its partners may share this information among themselves and use it. Your personal data is processed only within the territory of the Republic of Bulgaria, solely for the period and purposes for which it was provided.
10.1. What personal data we collect
When you register a profile, purchase a product, participate in a sweepstake, etc., we may collect various types of information, including but not limited to name, postal address, phone number, email, preferred communication method, or others. In cases where certain documents are required, such as an invoice, additional data may be requested from you in accordance with legal requirements. We store the order history for each registered profile on the site.
10.2. How we use personal data
We process your personal data to fulfill our obligations as a party to a sales contract for goods or services. Periodically, we may use it to send important messages such as notifications regarding orders placed, changes to the General Terms and Conditions, or other policies. If you have given consent, we process your data to inform you about current promotions and advertising activities. Once given, consent can be withdrawn at any time. If you have given consent to participate in certain events (contest, sweepstake, game, etc.), we process the data you provided to administer these activities. The data provided when applying for a job will be used solely for the purpose of selection and assessment of the candidate's suitability for the relevant position.
10.3. Disclosure to third parties
In certain cases, in order to fulfill our obligations under contracts concluded with you or legal obligations, it is necessary or we may be obliged to disclose the personal data you provided to our partners (e.g., transport, courier, service, IT companies, etc.) or to competent authorities.
10.4. Personal data protection
The Data Controller takes precautions, including administrative, technical, and physical measures, to protect your personal data from loss, theft, misuse, as well as unauthorized access, disclosure, alteration, or destruction. When you post on forums, chat rooms, or social network services, the personal information you share is visible to other users and may be read, collected, or used by them. In these cases, you are responsible for the personal information you choose to provide.
10.5. Integrity and retention of personal data
We will retain your personal data for the period necessary to fulfill the specific purpose for which it is being processed, after which it will be deleted, unless a regulatory act requires us to retain it for a longer period.
10.6. Data subject rights
You can check the accuracy, completeness, and currency of your personal data, as well as correct it, by logging into your profile. If you want to withdraw your consent for personal data processing, request a correction, object to its processing, or request that your data be deleted ("the right to be forgotten"), you should send a request to this effect by email to estore@palltex.com. To avoid abuse, requests with the above content will only be considered if they are sent from the email used for profile registration, and we reserve the right to request additional data to establish the identity of the requester and the data subject to whom it relates.
Requests related to personal data will be responded to within one month, and in the event of a need to extend this period, you will be informed of the extension and the reasons for the delay. We may refuse to process requests that are unreasonably repetitive or threaten the privacy of other users. In any case, you have the right to file a complaint with the Commission for Personal Data Protection, kzld@cpdp.bg, Sofia 1592, 2 Prof. Tsvetan Lazarov Blvd.
11. FEEDBACK, QUESTIONS, AND CONSULTATIONS
11.1. Every User can contact "Palladium" Ltd. to ask questions, make suggestions, and receive information.
